Section 13. Limitations on Use of MLS Information

1. Active, Active No Showing, Pending, Expired, Withdrawn and Temporarily Off-Market Status Information.

   Information from TREND compilations of Active and Active No Showing listing information, from statistical reports, and from any comparable report that includes properties that are Pending, Expired, Withdrawn or Temporarily Off-Market may be used by TREND Participants as the basis for aggregated demonstrations of market share or comparisons of firms in public mass-media advertising or in other public representations. This authority does not convey the right to include in any such advertising or representation information about specific properties which are and were listed with other Participants. 2. Settled Status Information.

   Use of information from TREND compilations from statistical reports, and from any comparable report about properties that are Settled for public mass-media advertising by an MLS Participant or in other public representations, is permitted. This authority conveys the right to include in any such advertising or representation information about specific properties which were sold (or leased) by other Participants (as either listing or selling broker or transaction licensee).

3. Required Disclosures.

   Any print or non-print forms of advertising or other forms of public representations based in whole or in part on information supplied by TREND must clearly demonstrate the period of time over which such claims are based and must include the following, or substantially similar, notice:
